ISTRABOOK GENERAL TERMS AND CONDITIONS

GENERAL

ISTRABOOK is a travel agency (hereinafter: ISTRABOOK) owned by the trading company Ferien Adriatic jdoo, which specializes in mediation in the rental of private villas with swimming pools ensure their guests the highest possible quality of service. All villas shown are under contract with ISTRABOOK and have all the licenses issued by government agencies.

INTRODUCTION

The rental contract that you conclude with ISTRABOOK as an intermediary, you conclude as a tenant (hereinafter referred to as the guest) with the owner of the villa – the holiday home (hereinafter referred to as the villa) as the lessor (hereinafter referred to as the owner). ISTRABOOK acts exclusively as an intermediary and can only be held responsible in this sense.

By paying the advance payment for booking the selected villa on the desired date, you unconditionally agree to these General Terms and Conditions, which are published on the ISTRABOOK website www.istrabook.com and come into force on the day of publication.

After ISTRABOOK has received the booking deposit, a written booking confirmation (hereinafter: the confirmation) will be sent to the guest. The written booking confirmation together with these general terms and conditions forms the rental agreement between the guest as tenant and the owner as landlord.

The guest must be at least 18 years old on the day of booking.

ARRIVAL AND DEPARTURE

The earliest check-in is at 4 p.m. on the day of arrival. The latest check-out is at 10.00 a.m. on the day of departure. Earlier arrival and later departure will not be possible.

Registration of guests

The guest is obliged by Croatian law to provide the villa landlord/host with official identification documents containing personal data for tourist registration purposes at the National Tourist Board (HTZ). This data will not be used for any other purpose. The guest who does not provide personal identification required by law for tourist registration may be denied access to the accommodation without the possibility of a refund of the rent paid.

VILLA

Number of guests

At no time may there be more people on the property than stated on the booking confirmation. The number of guests can be increased up to the maximum capacity stated on the villa’s website, with notification at least 3 (three) days before arrival. The desired change in the number of guests must be requested in writing by e-mail. The maximum number of guests also applies to children, regardless of age.

If there are more guests in the villa or its property than announced, the owner and/or ISTRABOOK reserve the right to terminate the rental agreement without notice with immediate effect. The guests will then leave the villa for good within 2 (two) hours. A refund for the unused period of the rental period will not be possible.

Younger guest groups

If guests are 25 years old or younger, they are considered a younger group of guests. Special conditions may apply to such groups, depending on each villa’s policy. ISTRABOOK must be informed of the age of the group in advance or immediately after reservation.

Failure to comply with this article may result in immediate cancellation of the booking, in which case guests will not be entitled to a refund of the rental fee paid.

Tents and caravans

No tents or caravans, etc., may be parked in or near the villa. If this prohibition is not observed, the owner and/or ISTRABOOK are entitled to terminate the rental agreement without notice with immediate effect. The guest will then leave the villa together with all the people accommodated there within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or ISTRABOOK.

Pets and allergies

Whether visiting with pets is allowed and under what conditions will be noted on the website of each individual villa. Pets are strictly forbidden from swimming pools. Any additional cleaning costs due to pets are listed on each villa’s website. During the booking process, the guest will indicate the number of pets. The surcharge for additional cleaning costs for pets (where applicable) will be automatically added to the rental price. The number of pets in the villa may not exceed the registered number stated on the confirmation. If the guest wants to bring more than 2 (two) pets, he will contact ISTRABOOK separately. No more than 2 (two) pets can be accommodated in one villa without written consent.

Dog owners are responsible for cleaning up their pet’s remains. Pets are not allowed to climb on furniture at any time. Any proof of animals on furniture can result in an increase in the final cleaning costs. All pets must be timely vaccinated against rabies and all other diseases in accordance with relevant regulations. Guests are advised to learn about possible diseases of pets in the travel area and to prevent them. The guest is solely responsible for keeping pets in villas. The owner and ISTRABOOK accept no liability for any illnesses or injuries of pets during the stay.

Pets are not allowed in some villas. However, neither the owner nor ISTRABOOK can guarantee that no pets were previously accommodated in the house or that the owner does not keep pets. ISTRABOOK assumes no liability for allergic reactions in guests that may occur in any holiday home.

In the event that the guest brings an unannounced pet, the owner and/or ISTRABOOK reserve the right to terminate the rental agreement without notice with immediate effect. The guest will then leave the villa together with all the people accommodated there within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or ISTRABOOK.

Newly built villas

When booking newly built villas, the guest must be aware that there may not have been enough time since completion for the lawn, plants, flowers and the like to be fully established.

Noise

If the guests disturb the public peace and order with noise and do not calm down even after a warning, this can be interpreted as a serious violation of the rental agreement provisions, whereby the owner and/or ISTRABOOK can terminate the rental agreement without notice with immediate effect. The guest will then leave the villa together with all the people accommodated there within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or ISTRABOOK.

Swimming pools

For their own safety, the guest will follow any instructions from the owner or ISTRABOOK

Observe use of the swimming pool. The guest is responsible in every way for the use of the swimming

Pools responsible. Children are only allowed in the swimming pool area under adult supervision. The guest uses the swimming pool at his own risk. If the accommodation is booked outside of the summer season, it is possible that the swimming pool cannot be used.

Please note that the use of hydromassage tubs and pools involves health risks – use is at your own risk. There is a possibility that the water in the hydromassage tubs will not be heated until the evening on the day of guests’ arrival. Climbing on covers of hydromassage pools/tubs is prohibited. The covers are for insulation only and their carrying capacity is not designed for human body weight, so they are easy to tear. If the cover is torn, the guest will compensate the damage directly to the owner.

House rule

There are separate house rules for each villa, which are posted in a visible place in the villa. Guests are obliged to abide by the house rules. If the guests do not follow the house rules, this can be interpreted as a serious violation of the rental agreement provisions, whereby the owner and/or ISTRABOOK can terminate the rental agreement without notice with immediate effect. The guest will then leave the villa together with all the people accommodated there within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or ISTRABOOK.

PRICES AND PAYMENTS

Unless otherwise indicated, all prices are in Euros per villa per week. Card payments are made in euros.

The booking is binding. A deposit of 30% of the agreed rental price must be paid in the booking process, confirming the booking and concluding the contract with the owner and accepting these General Terms and Conditions, which form an integral part of the rental contract. After the booking process has been completed and payment has been made, ISTRABOOK will send a written booking confirmation by e-mail, which will contain all the necessary information about the accommodation and, together with these General Terms and Conditions, will constitute the villa rental agreement concluded with the owner through ISTRABOOK. The rental agreement is considered concluded as soon as ISTRABOOK has received the down payment.

The costs for water, gas and electricity consumption, internet access, bed linen, kitchen towels, final cleaning of the interior, maintenance of the pool and the exterior, registration and local tax as well as sales tax are included in the rental price.

The following payment methods are accepted for the deposit: credit cards and bank transfer. All payments are to be made in euros (EUR). Accordingly, there is the possibility of exchange rate differences. ISTRABOOK cannot be held responsible for exchange rate differences and fees from other banks.

For the remainder (70% of the agreed rental price), all payment options apply as for the down payment. When paying by credit card and bank transfer, payment must be made no later than 30 days before arrival at the villa, so that ISTRABOOK can transfer the received payment to the owner.

If you wish to cancel your payment, you must contact us in writing at ferien.adriatic@gmail.com and explain your reasons for cancellation.
For cancellations up to (incl.) 60 days before planned arrival -0% of the total amount.
For cancellations up to (incl.) 30 days before planned arrival -70% of the total amount.
For cancellations up to (incl.) 29 days before planned arrival -100% of the total amount.

Bookings 30 days or earlier prior to rental

For bookings made 30 days or earlier before the start of the rental, the following conditions apply:

  1. The deposit of 30% of the total agreed rental price is due for payment IMMEDIATELY if credit card was chosen as the payment method. If the guest opts for the bank transfer, the deposit must be received by ISTRABOOK within 3 (three) days;
  2. The balance of 70% of the agreed rental price is due for payment no later than 30 (thirty) days before the start of the rental period, provided that the payment is made by credit card or bank transfer. If cash payment has been chosen (for villas where this option is accepted, which will be specified during the booking process), the balance of 70% of the rental fee is due for payment immediately after the guest’s arrival, allowing the guest to pay the relevant amount directly payable to the owner/host. Cashless payments cannot be made in the villas.

Bookings 30 days or less prior to rental

  1. The full rental fee is due for payment IMMEDIATELY when paying by credit card or bank transfer. Bank transfer cannot be chosen as a payment option if there are less than 15 days left from the day of booking to the day of arrival.
  2. Should the guest choose to pay in cash for part of the agreed rental price (for villas where this option is accepted, which is indicated during the booking process), the deposit of 30% of the full rental price is due for payment IMMEDIATELY while the balance of 70% is due for payment upon arrival of the guest. Cashless payments cannot be made in the villas.

Failure to meet payment deadlines

The guest accepts the obligation to make payments within the periods defined in this point of the general terms and conditions and in the manner explained here. If the guest does not adhere to the payment deadlines, this will be interpreted as a serious breach of contractual obligations, which means that the rental agreement is considered terminated without notice. If the rental agreement is terminated, amounts paid to Istrabook will not be refunded.

TERMINATION AND CHANGES

4.1. A concluded rental contract can only be terminated in writing (by e-mail). The termination is effective from the day it is received by Istrabook and only under the conditions specified in this point.

4.2. Should the guest be able to find another guest who can use the villa in his place in the same time slot, at the same price and under the same conditions, ISTRABOOK will immediately, after receipt of all necessary data about the new guest in writing, transfer the rental agreement to the make a new guest and send them a written confirmation of this. Already paid partial amounts of the rental price according to the transferred contract will be retained by ISTRABOOK, while the new guest has to pay the remaining amount up to the full rental price, depending on the previously selected payment method, which is an integral part of the contract.

4.3. It is not possible to change the reservation to another villa, as ISTRABOOK forwards all payments to the respective villa owners without delay.

4.4. If the concluded rental contract cannot be fulfilled or if the fulfillment of the contract is made significantly more difficult due to force majeure (e.g. war, natural disasters, environmental disasters, epidemic, border closure, strike, etc.), which was not foreseeable at the time of conclusion of the contract, ISTRABOOK and the owner can Terminate the rental contract, as neither ISTRABOOK nor the owner can be held liable for the occurrence of the aforementioned circumstances.

RENTAL SECURITY

The amount of the rental deposit to be paid by the guest to the owner/host upon arrival will be stated in the written booking confirmation. The security deposit serves as security for the owner against damage to the villa. If the damage caused is higher than the security deposit, the guest will reimburse the owner for the full amount of the damage. Provided no damage has been caused to the villa, the owner will return the rental deposit upon the guest’s departure.

DAMAGES NOT CAUSED BY THE GUEST

The guest assumes the obligation to use the rented villa responsibly. The guest must hand over the villa in the condition in which it was found. The guest is directly liable to the owner for any damage caused. Should the rental deposit not provide sufficient funds to cover damage, the guest will pay the difference directly to the owner/host up to the full amount of the damage.

Deliberate damage to property and disturbance of public peace and order will be interpreted as serious violations of the rental agreement provisions, which means that the owner and/or ISTRABOOK can terminate the rental agreement without notice and with immediate effect. The guest will then leave the villa together with all the people accommodated there within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or ISTRABOOK.

The guest will immediately inform the owner of the occurrence of damage to the villa and property around the villa within the rental period. Before the guest’s departure and the handing over of the keys, the guest will inspect the villa and the property around the villa together with the owner/host.

If no damage has been caused, the owner/host will return to the guest the rental security deposit of these Terms and Conditions – if deposited by the guest.

An additional cleaning effort due to the particularly poor condition of the villa after the guest has returned it to the owner/host can also be understood as damage, so that the owner/host has to pay for this damage from the rental security deposit.

EXISTING DEFECTS AND COMPLAINTS

Should the guest notice inadequate cleaning, damage and other defects in the villa when taking over the villa or have any other complaints, he will complain immediately, but in any case within 24 hours. Complaints about inadequate cleaning must be reported immediately. The complaint is made directly to the villa owner or his authorized representative.

The guest is obliged to prevent or limit the occurrence of damage as far as possible and to help ensure that any type of loss for the owner remains as small as possible.

In the case of any type of complaint, the guest will set the owner a reasonable period of time to remedy the defect.

Leaving the villa before the end of the agreed rental period and without prior notice and consultation with ISTRABOOK is at the risk and expense of the guest, with ISTRABOOK accepting no liability whatsoever.

The villa owner is responsible for any deviations from the condition of the villa as stated on the ISTRABOOK website.

ISTRABOOK AS AN INTERMEDIARY

ISTRABOOK is a travel agency that acts as an intermediary in the rental of villas on the basis of brokerage contracts for accommodation services concluded with villa owners. ISTRABOOK does not own any villas. The owner, through the contracts concluded with ISTRABOOK, has taken on the obligation to provide accurate and complete information about his villa, so that he has full responsibility towards the guest. If, contrary to ISTRABOOK’s expectations, the booking cannot be completed due to circumstances beyond ISTRABOOK’s control, e.g. as a result of a court-initiated sale or a gross breach of contract by the owner, etc., ISTRABOOK can cancel the booking and the payment already made by the guest refund the agreed amount immediately.

FINAL PROVISIONS AND JURISDICTION

9.1. ISTRABOOK transmits all information about villas to its website and tries to provide the most accurate and up-to-date information it receives from villa owners. The sole responsibility for providing accurate and complete information about the villas lies with the owners, so ISTRABOOK cannot be held liable for any inaccurate, incomplete or incorrect information.

9.2. Any use of the data published on the www.istrabook.com website for commercial purposes, including any form of partial or complete reproduction, constitutes copyright infringement and is prohibited by law.

9.3. In the event of violations of the provisions of this Rental Agreement, the Owner (in consultation with ISTRABOOK) and/or ISTRABOOK may terminate the Rental Agreement without notice and with immediate effect. The guest will then leave the villa together with all the people accommodated there within 2 (two) hours and will not be entitled to a refund of the paid rental amount from the owner or ISTRABOOK.9.4. The contracting parties will settle any disputes amicably and peacefully. The locally competent court in Zagreb applying Croatian legal norms shall be responsible for all disputes.
